    I have been noticing a lot of people moving changing jobs using EAD. Especially a lot of June and July 2007 filers.

    The time to renew EAD is approaching and I am sure there is going to be a surge in EAD renewals.

    There was also a recent communication from USCIS that one must not apply for renewal prior to 120 days of their EAD expiry date.

    In past has anyone been in a situation where they are not able to renew EAD in time and how you handled it?

    Do you plan to apply for EAD exactly in the 120 day range to make best use of time? What if EAD renewal gets severly backlogged?

    I think this is something we must all concentrate on and try to get some answers from USCIS on this as it will help planning.

    Better not, US does exactly the opposite to what someone asks her :D
    I think India must ask US to send back all the skilled H1b holders exactly after 6 years and not issue GC. Then you would be surprised to see heck of a lot approvals !!!!

    Hi,

    I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?

    This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

    Slightly sooner than expected but the H1B cap was reached today. U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2011. USCIS is notifying the public that yesterday, Jan. 26, 2011, is the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY2011.

    The final receipt date is the date on which USCIS determines that it has received enough cap- subject petitions to reach the limit of 65,000. Properly filed cases will be considered received on the date that USCIS physically receives the petition; not the date that the petition was postmarked. USCIS will reject cap-subject petitions for new H-1B specialty occupation workers seeking an employment start date in FY2011 that arrive after Jan. 26, 2011.

    USCIS will apply a computer-generated random selection process to all petitions that are subject to the cap and were received on Jan. 26, 2011. USCIS will use this process to select petitions needed to meet the cap. USCIS will reject all remaining cap-subject petitions not randomly selected and will return the accompanying fee.

    On Dec. 22, 2010, USCIS had also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the �advanced degree� exemption. USCIS will continue to accept and process petitions that are otherwise exempt from the cap.

    Those who missed the filing this week, should get ready to file on April 1, 2011 for the FY 2012 term, we feel that visas will run out fast this coming April.

    This is key. We've been hearing that the White House was still up in the air between the energy bill and immigration and that one of the two would likely be pushed back until after the election. Now it looks like the White House thinks it can walk and chew gum (presumably after the President's approval ratings are slipping as people sense the White House is not actually keeping any of its promises).

    According to CIS ,they will take time upto 26th Oct ,just to issue the receipts. Again they say ,it might not be that longer but what I think we are not going to get the receipts anytime soon. At the same time we need not file another application if we dont hear anything from them till 15th of August,since we have the mail delivary proof that the application was accepted at TSC.
    So there is no other alternative but to wait for either a receipt or checks getting cashed...

    3% seems very good.
    Also if you can set aside some money for >3 years, putting it in an NRO term deposit is also pretty good. Now they range around 7.5 to 8%. You can repatriate the interest income after due taxes are paid.

    I am currently working for big consulting firm, they hold my H1 and 485 is pending for more than 6 months. i have valid EAD from pending 485.

    I am getting full time opportunity, my new employer is ready to transfer H1 as well as they are willing to accept me using EAD. so its entirely my preference.

    can you please tell me adv/dis adv of using H1 over EAD or vice versa. (my 6 yrs of H1 will finish in another 6-7 months)

    If they are willing to process H1B, go w/ H1B. You will get 3 year extension since 140 is approved. Also, at the same time file for AC21. You are all set.

    This bills is to renew Conrad 30 program which is set to expire June 2008. This bill is sponsored by Zoe Lofgren and has been posponed until the undetermined date!

    This is a vital provision for J1 physicians for waiver opportunities but I have not found much on this on the internet besides above quote from Oh law firm.

    Hi Cooler,

    Thank you for your response. Company B is not willing to sponsor H1B.

    Lets say if campany A keeps paying me (runs my payroll with salary specified on my H1 petition) Will that keep my H1b alive and active when i work on EAD for company B ? ( Did i get that right )

    Will USCIS know that i have switched jobs in between ?

    What does IMHO mean ?

    Like Tom said, EAD is irrelevant to your studying on parolee status. The only thing is you cannot work during the EAD gap.
