One think people don't get is, whether the current/future job qualify for EB2, It doesn't matter even you have a Phd and the job only requires Bachelor or equivalent then it is EB3, also certain programming jobs doesn't qualify for EB2. First ask your HR for min job requirement!:(

1) If A# is not available so we need to populate it with I-94# ? I got
this weird idea from Point 10 of I-765 form where it says A# or I-94#
Of course in other places it just asks A# ( specially in I-131 form)
2) For I-131 there are lot of doubts - want to double check
a) Class of Admission - ?
b) A# is the very first Information sought !!
c) Date of Intended Departure and Expected length of Trip
d) For how many Trips you intend to use
3) In G-325A Bigraphic form also at the end - it again asks for
ALIEN REGISTRATION NUMBER - what is the that ??

Hello All,
I'm in a big fix now, need immediate suggestion and help.
I have a valid H1B petition filed from SC, now I had moved to FL and started working on a prj. I have planned for my trip to india early june and then I came to know from my lawyer that I need to have a new LCA and H1B amendment before traveling to india and appearing for visa interview.
They had already filed for my new LCA which I have got and they had applied for my H1B premium amendment also but I haven't got the new petition yet.
I have applied for the visa interview by filling all the DS-160 forms for my family based on old petition number.
Can I can still go ahead with the interview and carry the new amended petition in my hand OR should I cancel the existing interview and once again fill the new DS-160 forms and take the new interview date ?
Please let me know on this....

I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".
I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.
However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?
Urgent response will be greatly appreciated.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

Yes there is away to track your 140.
Goto https://egov.immigration.gov/cris/jsps/index.jsp and create your profile and you will be able to track the process. THere is option to receive email from USCIS whenever there is a change in your file (you have to select that option)

Gurus - I have few questions and I need your help:
1. My EAD/AP expires in June/July '08. Can I apply for their renewal now?
2. Will there be a finger-printing requirement for the renewal? We had finger print in June 2007 when we applied 485/765/131 together?
3. Is it better to efile or paper file?
4. I will be in India from April to June this year. I have an AP valid till end June. Can I file for EAD/AP renewal and leave for India in April. Is there any risk? I can still use my current AP to enter when I come in early June, right?
