True up to some extent. When filing AOS, you still "intent" to join for the exact same employment (including location), as specified in your LC. You are NOT required to take that exact employment "at the time" of filing AOS. What is required "at the time of filing AOS" is to have a legitimate intention to take that exact employment upon GC. By joining for that exact employment from anytime now, will actually help in proving the "legitimacy" of your intention (but not "required").
My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

I had this experience in the past...when my H1 Extension is applied sometime back, they gave me a new i-94 number (probably due to an error)....however, when I left the country for a vacation, I stapled & returned both I-94's as per my attorney's suggestion (through my emp)...

Hello guys,
I am sending my family based I-485 on May 1. currently i am on h1b . My h1b approval (I-797A) is valid till April 15, 2009. my h1b extension is already pending with USCIS. My Question is :::----
Is there gonna be any problem with USCIS since my h1b approval already expired?? what will be my status after i filled my I-485?? Can i legally stay in US after filing family based I-485 even my h1b extension get denied.???

Use the AR 11 online process to change address do it seperately for yourself and your wife. When you have finished submitting new address the system will prompt you asking if you have any pending applications with USCIS. At that time enter the receipt numbers of all pending applications. This will do the needful. You can track the success by checking the case status in few days you can see a soft LUD on your pending applications. Also in few weeks you will receive a letter from USCIS at your new address that tells that they have updated the address. Some folks even call USCIS and verify the address change.

I would suggest to apply for the extension now and atleast carry a application receipt with you. And if you are planning to enter the county in July - Sug time, frame, I would suggest that you carry the approval notice as well.
I had the same issue with H1B. Even through my H1B was valid but it was expiring within a months time when I was re entering US after a business trip. I was suggested by my lawer to carry the H1B extension approval notice.

If the H1B is filled by his company it will be rejected. If it is filled by another company then there are no issues.

Yes, just make sure that you file all forms and pay all taxes :( even if you are not in US.

I have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.
